ENVIRONMENTAL

  1. Interviews with past and present owners, operators and occupants

  2. Copies of any violations, complaints or requests for information regarding environmental, workplace safety and health (from private parties or governmental authorities)

  3. Historical sources of information (i.e. aerial photographs, fire insurance maps, chain of title documents, and land use records)

  4. Federal, state, local and tribal government records

  5. Records concerning adjoining or neighboring properties

  6. Permits and records relating to environmental matters such as underground storage tanks, air quality, water use, solid/liquid wastes and hazardous waste storage or disposal

  7. Any records of environmental cleanup liens

  8. Listing of hazardous substances (i.e. asbestos, pesticides or petroleum products) and any intentional or accidental spills/ releases of the material

  9. Details on workplace safety and health programs

  10. Description of any toxic chemicals used in production and manner of storage and disposition.

  11. Description of any Environmental Protection Act, Toxic Substances Control Act or other investigation or claim.

  12. Environmental surveys, site assessments or reports (including copies of any Phase I and Phase Il reports) concerning any real property currently or formerly owned or leased by the Company.

  13. Environmental, health and safety compliance verification reports (e.g. compliance audits) and quality assurance documents.

  14. Copies of any internal reports or memoranda prepared by the Company or third parties relating to hazardous materials, health and safety or other environmental matters.

  15. Correspondence, memoranda, notes or notices of violation from foreign, federal, state or local environmental, health and safety authorities.

  16. Any "potentially responsible party" letters or other similar notices or requests for information from any governmental or regulatory authority.

  17. Identify where finished product, inventory and raw materials are being stored.

  18. Identify methods of waste disposal: paperboard waste; hazardous waste; effluents.

  19. Determine whether they are any drums or waste buried on project premises.

  20. Determine whether any projects are subject to an environmental compliance schedule, consent order or administrative order and whether any project received notice that it is not in compliance with applicable environmental laws.

  21. Determine if any projects operate under an air or water pollution permit. Determine if any projects have underground tanks. If so, obtain a description of them including age.

  22. Provide general information about the age of the project(s), former operations, prior land use, prior owners to the extent possible. Determine whether any environmental audits or assessments have been done. If so, obtain copies of reports.

  23. Describe the status of the environmental clean-up efforts in progress.

  24. Determine what steps have been taken to ensure compliance with the Environmental laws.

  25. Determine environmental problems, and what the Company plans to spend between (dates) on environmental matters.

  26. Schedule of Hazardous Materials stored, manufactured or located at any facility of the Company either now or in the past, or that the Company ships or transports (Hazardous Materials means any substance or any material containing a substance that could be considered toxic or hazardous under Federal or state law, including solvents, petroleum, pesticides, paints, asbestos containing materials, lead based batteries, radioactive materials and PCB containing transformers.)

  27. Schedule of chemicals, toxic substances or air contaminants which are regulated by OSHA present in any facility of the Company.

  28. Schedule of any incidents involving the release of a potentially hazardous amount of any carcinogen into, or presence of asbestos in, the workplace.

  29. Schedule of all instances in the past in which the Company has corrected unsafe working conditions.

  30. Schedule of all the facilities of the Company that discharge waste into any body of water, stream or any sanitation systems.

  31. Schedule of all permits or approvals obtained from any governmental body responsible for environmental or health regulation.

  32. Schedule of all occasions in which a liquid or solid waste material or any fuel or other Hazardous Material was accidentally or intentionally spilled or released.

  33. Any notices of violation or requests for information that have been received or threatened at any time for alleged failure of any facility to comply with applicable air pollution laws or with any air quality permit.
